how are you guys, hope all of you in the good health and in the blessing of Allah SWT.
without noticing it, it was already the third week of the semester..
there were many thing we had done that make us forgot what happen around Aikol..but rest for assured because we try to update the news..
please take note that all tutorial classes  start by this week.
Let refresh what we had done in past two week . For your information, Lawsoc had  already conducted two programs,
-Mass Gathering for subcommittee and group binding for Lawsoc excoes..
and we also had finished our Almanac and waiting for approval.
-today 28/12/2010, we will have Baiah ceremony, this programs is compulsory to all Lawsoc  Excos, this program will be held at executive meeting room at 2pm. At night we will depart to Seri Pentas for 'Halaqah' program. if anyone interested to joint please come to our office and but it is limited to 30 person only. first come, first serve..
We at Lawsoc try our best to meet the need of Aikolian but within our limit...

Ahmad Ibrahim Kulliyyah Of Laws

In the Ahmad Ibrahim Kulliyyah of Laws (AIKOL), students read the Malaysian law, the common law, Islamic law and international law. Students are taught the theoretical side, as well as trained in the practical aspect, of the laws.
This Kulliyyah aims to produce judges and lawyers capable of practising in both the civil court and the Syariah court systems. In order to achieve this, the Kulliyyah offers the programmes of Bachelor of Law (LL.B), LL.B (Shariah), Master of Comparative Law (MCL) and Ph.D.
The kulliyyah was set up and came into existence in 1983, simultaneous with the establishment of the International Islamic University Malaysia. From a modest establishment with 3 teaching staff and 59 students, the Ahmad Ibrahim Kulliyyah of Laws has grown and developed rapidly. At present, there are about 112 teaching staff, more than 2,000 undergraduate students and more than 300 postgraduate students.
AIKOL offers an integrated curriculum wherein Islamic law is taught alongside the civil law. The concept of this curriculum was devised by its founding father: Al-Marhum Professor Emeritus Tan Sri Datuk Ahmad bin Mohamed Ibrahim (1916-1999).

In the era of modernization throughout the world in the race with a pace of ups and downs of globalization, there are many revolution and modification from a game of football, technology and even jurisprudence that have puzzled and systemized us in many years. Yet the conflict still exist which indirectly proportional to the rate of globalization as each day is triggered with a problem to be solved. Even Shariah law is not excluded from this progression as recently a case in Malaysia of non-Muslim Indian women challenged ruling that only Muslim lawyers are allowed to practice at Shariah Court which has make us ponder as could it be possible for such resolution towards the new reformation of Shariah law?

SECOND PLACE: Can a Non-Muslim Be Sharie Lawyer?


CAN A NON-MUSLIM BE SHARIE LAWYERS?
Lately we were shocked by the news from main stream media about the judgement made by Kuala Lumpur High Court which consent the judicial review (mandamus) to suit the application of Victoria Jayaseelee Martin, a Christian lawyer, who wants to be a Sharie lawyer. On May 14, she won approval from the High Court to challenge the rule. The date for the hearing is yet to be fixed. The judicial review is one of the branches of the court’s inherent jurisdiction. Based on the courts authority (refer to common law), to review the legal action made by the executive and legislative party, courts must make decision that either the statute is permitted or vice versa with our constitutional (constitutional in nature) or either the result concluded by executive party that rely upon particular policies which in line with constitution. On the other hand, the reason that had been used by this applicant to be Sharie lawyer is because ‘to uphold the justice’.

Mampukah Perjanjian Damai?


Mari kita mengulangkaji sejarah perlanggaran piagam-piagam dan perjanjian-perjanjian oleh pihak Zionist Israel (Israel) yang kononnya inginkan perjanjian damai serta diplomasi dalam menyelesaikan isu di Palestin.

Pelanggaran Israel terhadap Undang-Undang Antarabangsa

Resolusi 181 – Pertubuhan Bangsa-Bangsa Bersatu (PBB) hanya memperuntukkan 55% dari negara Palestin kepada pandatang Yahudi. Tetapi, Israel telah menawan lebih banyak daripada peruntukan itu iaitu sebanyak 77% selepas berjaya memengani peperangan pada tahun 1948 antara Penduduk Arab. Sebuah persetujuan yang ditaja oleh Amerika Syarikat iaitu Rhodes Armistice (Perjanjian Damai Rhodes) pada tahun 1949 meluluskan tambahan wilayah yang dikuasai oleh Israel.

Resolusi 194 (III) –Keizinan diberikan kepada pelarian Palestin untuk kembali ke rumah-rumah mereka selepas 800,000 rakyat palestin diusir oleh pengganas yahudi selepas perang 1948. Kini setelah 61 tahun resolusi ini diluluskan, Israel masih tidak membenarkan pelarian tersebut pulang. Bilangan pelarian Palestin di khemah-khemah pelarian di Jordan, Syria dan Lebanon kini telah mencecah lebih dari lima juta orang.

Resolusi 242 - Pengishtiharan pendudukan Israel di baitul Maqdis timur (seluruh Tebing Barat dan Semenanjung Gaza) adalah tidak sah dan Israel wajib berundur ke garisan Hijau seperti yang dipersetujui dalam perjanjian Rhodes pada tahun 1949. Sehingga hari ini Israel masih berdegil.

Resolusi 237 - PBB menolak pendudukan Baitul Maqdis dan pengisytiharan Israel sebagai ibu negara.

Resolusi 405 - Pada tahun 1988, PBB secara jelasnya memperakui Baitul Maqdis sebagai wilayah Palestin yang diduduki.

Israel telah mengistihar Baitul Maqdis sebagai ibu negara abadi Israel pada 30 Julai 1967. Pengisytiharan Israel ini diperakui oleh pentadbiran Bush apabila Presiden Bush menandatangani The State Department authorization Act (HRH 1646) pada 30 September 2002, sesuatu yang tidak pernah dilakukan oleh Presiden-Presiden sebelum beliau. Natijah dari akta tersebut, arahan dikeluarkan agar semua dokumen rasmi Amerika Syarikat mesti merujuk Baitul Maqdis sebagai ibu negara Israel.

Liga Negara-Negara (League of Nations), badan dunia yang mendahului PBB telah membuat penyiasatan pada tahun 1937 ke atas kedudukan ’Tembok Al-Buraq’ (tempat Nabi Muhammad s.a.w. mengikat tunggangannya dalam peristiwa Isra’ dan Mikraj) dan mengesahkan ia sebagai warisan yang dimiliki umat Islam.

Israel kini berita-cita untuk merobohkannya dan menggantikan dengan sinagog mereka yang diberi nama 'Haikal Sulaiman'. Dalam hal ini Israel telah meletakkan tuntutan ke atas ’Tembok Tangisan’ (Wailing Wall) iaitu sebahagian daripada tembok sebelah barat Haram Al-Sharif.

Apabila berlaku rusuhan Tembok Buraq (The wailing wall’s riot) pada tahun 1929, Suruhanjaya yang dibentuk oleh Israel juga menuntut kedaulatan ke atas ’kawasan Yahudi’ yang terletak di sebelah barat Haram Al-Sharif. Kawasan ini pada asalnya merupakan kawasan Arab, dan penempatan Yahudi dibina di atas tanah wakaf umat Islam. Tidak ada sebidang tanah pun yang menjadi milik Israel atau Yahudi.

Perjanjian Oslo 1993 - Israel akan menghentikan pembinaan penempatan Yahudi di baitul Maqdis timur dan Tebing Barat. Tetapi, Israel giat mendirikan penempatan tambahan Yahudi selepas Oslo.

Kes pembinaan perumahan Yahudi di Jebel Abu Gneim (Yahudi merujuknya sebagai Har Homa) di Baitul Maqdis dan di tempat-tempat lain adalah isyarat jelas bahawa Israel mengolok-olokkan Perjanjian Oslo ciptaan mereka sendiri.

Tujuh tahun pasca Oslo, bilangan pendatang Yahudi di Tebing barat meningkat sekitar 100,000 orang kepada sekali ganda dari bilangan tersebut. Selain itu, Oslo juga mensasarkan dalam tempoh lima tahun selepas Oslo (1998), status muktamad negara Palestin akan diputuskan berdasarkan kepada Resolusi 242 dan 338 iaitu Israel akan berundur sepenuhnya dari wilayah yang diduduki pada tahun 1967. Kini (2010) iaitu 17 tahun pasca Oslo, negara Palestin merdeka yang dijanjikan tetap menjadi fatamorgana yang memperdayakan.

Tahun 1999 - Regim zionis telah membuat penegasan berikut yang amat jelas bertentangan dengan isi kandungan perjanjian Oslo iaitu:

1. Israel sama sekali tidak akan berundur daripada sempadan sebelum 6 Jun 1967 (tarikh bermulanya Perang Enam Hari, 1967);
2. Baitul Maqdis kekal sebagai bandaraya yang disatukan di bawah kedaulatan Israel sebagai ibu negara Israel
3. Penempatan Yahudi (di wilayah yang diduduki) kekal di bawah kedaulatan Israel.

Mahkamah Keadilan Antarabangsa (International Court of Justice (IJC) memutuskan bahawa tembok pemisah yang dibina oleh Israel sebagai melanggar hak-hak rakyat Palestin dan perlu dirobohkan

Israel telah menubuhkan tembok Apartheid yang memisahkan penempatan-penempatan Yahudi di Baitul Maqdis Timur dan di sepanjang Tebing Barat yang bersempadan dengan Israel (sempadan wilayah yang diduduki pada tahun 1949).

Israel cuba berdolak-dalih dengan mendakwa tembok yang dibina sebenarnya adalah ‘pagar’ (fence) sementara dan bukannya ‘tembok’ (wall). Namun, hakikatnya tembok itu membawa implikasi pendudukan kekal Israel ke atas 43% dari wilayah Tebing Barat dan meletakkan baki 57% lagi dalam daerah-daerah yang terpisah-pisah.

Untuk meyakinkan dunia tentang sikap perikemanusiaan dan belas kasihan, Israel menyediakan 41 pintu-pintu pertanian untuk rakyat Palestin menguasaha ladang mereka. Hakikatnya tembok itu bukan sahaja memisahkan di antara keluarga rakyat Palestin, malah menyebabkan mereka kehilangan tanah pertanian mereka yang tidak lagi boleh diusahakan. Tembok itu memberi laluan kepada Israel untuk mengambil alih lebih banyak kawasan Arab yang dikepungnya.

Resolusi Majlis Keselamatan PBB 1860 - Saluran barangan keperluan dan agihannya di seluruh Gaza mestilah berlaku tanpa sebarang sekatan, dan ini termasuk makanan, bahan api dan keperluan perubatan.

Kini Israel mengenakan sekatan ekonomi menyeluruh dan mengepung Gaza dengan menutup semua laluan udara, laut dan jalan darat sejak dari tahun 2007 sehingga menjerumuskan Gaza ke dalam krisis makanan, ubat-ubatan dan lain-lain bahan keperluan asas yang kritikal.

Amerika Syarikat yang kononnya mempertahankan hak asasi manusia berdasarkan Deklarasi hak Asasi Manusia sejagat (Universal Human Rights Declaration 1948) hanya melihat sahaja tindakan biadap Israel mengenakan sekatan ekonomi ke atas gaza, bahkan melakukan serangan paling ganas ke atas gaza pada penghujung tahun 2008 dan awal tahun 2009 menyebabkan 1,500 penduduk Gaza terbunuh separuh dari mereka adalah wanita dan kanak-kanak.

Jadi, siapakah pengganas sebenar dan siapa mangsa keganasan? sehingga tiada satu jaminan yang kukuh..mana mungkin jalan perjanjian damai boleh diyakini lagi.

A Special Committe to Protect the Safety of Malaysian Lawyers

A trial is going on. Lawyers from both sides cross swords. The stakes are high. In the name of justice, they battle it out, only for one side to emerge victorious. The loser did his best to protect his client’s interest, only to find a bullet right through his temples a week later. Sound familiar?

In today’s modern and complex society, where rule of law is expected to be adhered to, lawyers are facing threats and assaults more than ever before. Clients whose best interest they serve are biting back. Others with vested interest in a case threaten lawyers to get their way with things. As agents of justice, lawyers are being compromised. The murder of Datuk SP Annamalai in 2007 and N. Selvamani in 2006 are just two of the many incidents that illustrate this problem.


The Malaysian Bar Council, in response to the matter, is in the midst of setting up a special committee to ensure protection for lawyers against such vile attacks. Selangor Bar chairperson Rajpal Singh had been appointed to see through the setting up of this committee by March 2009. Currently at the preliminary stage, the function of the committee includes holding dialogues and forums with the police and raising awareness amongst lawyers on the issue.


With all due respect, such committee cannot provide “real” protection to lawyers. Lawyers are truly protected in the compound of courts with the presence of policemen. Apart from that, once they are off court limits, they are on their own. That is the underlying point. Policemen cannot be there for you all the time. To expect them to accord the total 12,777 lawyers in Malaysia with extra care and attention would be impractical.


Nevertheless, one way in which the committee can safeguard lawyers better is to establish better links with the police. Set up a complaints bureau within the committee. Threatened lawyers who have lodged a police report can forward such report and complaint to the bureau for following up purposes. The objective here is for the committee to act as a ‘check and balance’ task force to ensure prompt action is taken by the police on the reports made. This must be distinguished from the viewpoint of giving lawyers preferential treatment. It is not. Every citizen has a right to have the police protect him or her. In this case, the committee ensures that such protection, in the form of investigation and so forth, is given to its members upon making the police report. A case in point, the death of a murdered Israeli lawyer, David Haham on June 2008 could have been prevented if the police took his complaints of imminent threats seriously, rather than ignoring it totally. This is where the committee can step in to prevent such ‘ignorance’.


Lawyers themselves must also realise that they can contribute to their own predicament. Unethical and unprofessional conduct, giving empty promises, charging unreasonable fees, lack of communication skills (to the extent of provoking the client) and so forth can lead to unnecessary problems. The committee can play a role by ensuring Bar members adhere strictly to their professional conduct. Forums, seminar, dialogues and continuous education on legal ethics organized by the committee can play a major role to raise awareness and alertness amongst lawyers. The disciplinary board of the Bar can also liaise with the committee for such purposes.


Further, workshops can be organized by the committee to equip lawyers with know-how in dealing with dangerous situations. Simulations can be used to prepare lawyers for real life situations. Security systems in legal firms and safety measurements and guidelines can also be promoted via these workshops. Organizing self defence classes is also an alternative which the committee can ponder upon.


The setting up of a special committee to protect lawyers is not new. In Canada, the Lawyers’ Rights Watch Canada (LRWC) promotes the implementation and enforcement of designed international standards to protect the independence and security of human rights lawyers around the world. They campaign for lawyers whose rights, freedoms or independence are threatened as a result of their human rights advocacy. LRWC is also an NGO in Special Consultative Status with the Economic and Social Council of the United Nations. However, this committee is specifically on human rights lawyers per se, whilst the Bar Council’s proposed committee goes across the board. Nevertheless, the LRWC can provide a template and reference point to smooth out teething problems in the establishment of the committee.


The idea of setting up a special committee is apt and timely. The problem faced by Malaysia is still relatively small compared to countries like Sri Lanka and Bangladesh where the legal profession faces possible extinction due to lack of regard for the rule of law. Lawyers are scorned upon and assassinated since the 1980s for various reasons.


Let us hope that such tragedy shall never reach our shores.

Peguam Syarie: Org Islam v Bukan Islam

Antara isu terhangat di kalangan pelajar undang2 di AIKOL ialah, boleh kah seorang bukan Islam menjadi Peguam Syarie di Mahkamah Syariah? Hari ini di akhbar Berita Minggu ada satu rencana yg ditulis oleh wakil Persatuan Peguam2 Muslim Malaysia mengenai “ketidakbolehan” orang bukan Islam utk menjadi Peguam Syarie. Saya pun terpanggil untuk memberi idea utk menambahkan literature review di dalam isu ini.

Jawapan saya, org bukan Islam BOLEH menjadi Peguam Syarie kerana:

1. Tidak ada nass yg menyatakan peguam itu mestilah seorang Muslim. Hakim, mesti seorg Muslim berdasarkan sunnah rasulullah dan ayat Quran yg tidak membenarkan orang bukan Islam di jadikan pemimpin kepada org Islam.

2. Tidak menjadi syarat bahwa seorg peguam mesti seorg Islam untuk defend seorang pelanggan Muslim. Jika hendak dibuat qiyas pada isu yg sama; seorang peguam tidak semestinya seorg penjenayah jika clientnya adalah seorang penjenayah.

3. Di dalam Islamic legal system, peguam adalah pembantu kepada hakim supaya mereka sama2 berjaya membuktikan kebenaran berpandukan bukti2 yg dibentangkan di dalam mahkamah. Hakim adalah org yg paling “berkuasa” di mahkamah .

4. Ramai di kalangan ahli2 akademik bukan Islam yg popular dgn Ilmu islam yg mereka ada,[ dgn izin dan rahmat Allah]..seperti John Esposito, Karen Armstrong, David S. Powers, H.R. Gibbs. Mereka ini, tahu membaca Bahasa arab dan well versed di dalam syariah. Ya, sudah tentu ramai ulama’ terkenal dikalangan orang islam. Tidak syaa nafikan.

5. Berbalik kepada isu no 4, kenapa mereka tidak memeluk agama Islam dgn Ilmu islam yg mereka ada? Tiada siapa boleh menjawab. Ini hak Allah, jika tiada hidayah dari Allah dan izinNya, mereka tidak akan memeluk Islam.

6. Usah kita khuatir, usah kita takut. Sebagai orang Islam, saya percaya dengan jiwa raga saya yg hanya Islam agama yg diteirma disisi Allah. Islam adalah agama sempurna yg tiada cacat celanya. Justeru itu, biarkan mereka mendalami Ilmu islam, biarakn mereka menggali khazanah agama terbaik ini.. biarkan mereka tahu betapa cantiknya islam dan betpa adilnya undang2 Islam.Biar mereka baca Quran dan hadith serta membuka kitab2 lama utk mencari pendapat2 ulama2 terdahulu dan sebagainya.

7. Jadikan isu ini sebagai method of da’wah. Jalan utk kita berdakwah kepada mereka. Mudah2an dgn terbukanya jalan ini akan memperluaskan lagi bidangkuasa mahkamah syariah di Malaysia.

Akhir kalam, Shariah yg diturunkan melalui Nabi Muhammad S A W adalah untuk manusia sejagat utk memberi kemaslahatan kepada kita semua, Islam atau bukan Islam..

ANEH !


Bukan masanya lagi kita bertolak ansur! Bukan waktunya lagi mahu berdiplomasi! Sudah lama kita terlalu mahu menjaga hubungan, akhirnya ditelan juga mentah-mentah. Fahamkah anda maksud kata-kata ini? Ini bukan isu Negara Palestin, yang kini telah mendapat perhatian seluruh dunia, tetapi ini isu Negara kita, perundangan Negara yang melibatkan kedudukan agama Islam di Malaysia semakin dicabar!

14 Mei 2010, Sabtu baru-baru ini, akhbar Utusan Malaysia di muka hadapan telah membuatkan mata terpaku, seakan jam saat di seluruh dunia berhenti berdetik apabila terpandangkan satu tajuk aneh “ WANITA BUKAN ISLAM DIBENARKAN MENJADI PEGUAM SYARIE’. Berikut adalah fakta kes rentetan daripada tajuk akhbar tersebut.Seorang graduan Diploma in Syariah Legal Practice (DSLP) Universiti Islam Antarabangsa Malaysia,2004, Victoria Jayaselee telah memohon kepada mahkamah untuk mengeluarkan satu perintah mandamus terhadap MAIWP ( Majlis Agama Islam Wilayah Perseketuan) untuk mengenepikan keputusan MAIWP menolak permohonannya untuk menjadi peguam syarie di Wilayah Persekutuan. Semenjak dari tahun 2004, dia telah membuat beberapa permohonan tetapi kesemuanya ditolak oleh MAIWP termasuk permohonannya yang terbaru ini.

Namun begitu, Hakim Mohd Zawawi memutuskan agar keputusan MAIWP itu dipersoalkan dan diteliti semula untuk meluluskan permohonan seorang yang bukan Islam untuk menjadi peguam syarie. Ini merupakan satu kekeliruan yang maha besar yang dilakukan oleh mahkamah apabila mengabaikan beberapa peruntukan undang-undang negeri yang menyebut secara jelas syarat utama menjadi peguam syarie adalah ISLAM. Di sini saya tidak berhajat untuk mengupas secara terperinci kes tersebut dari sudut akademik perundangan, namun apa yang lebih muhim adalah ia pastinya berkaitan dengan kedudukan Islam dan perundangannya di Malaysia semakin terancam. Mereka, waima Yahudi atau Nasrani tidak pernah akan redha kepada kita selagi mana kita tidak mengikuti jalan mereka. Rantaian agenda mereka untuk melenyapkan Islam kini telah mula merebak ke dalam system perundangan Islam Negara kita.

Apa yang akan berlaku sekiranya permohonannya diluluskan mahkamah dan MAIWP dengan penuh berat hati menerima permohonannya? Kita akan melihat kepincangan sistem Mahkamah Syariah apabila kes-kes yang berkaitan dengan hokum syara’ dihujahkan oleh seseorang yang tidak mempercayai sumber kepada hujahnya iaitu Al-Qur’an dan Sunnah. Diputar belitkan, dipermudahkan, diremehkan dan disalah ertikan sehingga yang salah dikatakan benar dan yang benar dikatakan salah. Kita juga mengakui kepetahan mereka terutama golongan berbangsa india dan singh mempunyai satu kemahiran berhujah yang meyakinkan dan atas kelebihan ini, tidak mustahil mereka akan berjaya mengenepikan hak-hak syara’ demi mengutamakan hak-hak logik mereka.

Saya percaya, dendam mereka kepada beberapa keputusan Mahkamah Syariah yang tidak memihak kepada mereka terutama dalam kes salah satu pasangan bukan Islam memeluk Islam itulah puncanya. Seringkali isu ini berbangkit apabila pasangannya yang masih bukan Islam menuntut harta pusaka, harta sepencarian, hak penjagaan anak dan pernah juga beberapa kes tentang menuntut jenazah untuk dikuburkan secara bukan Islam. Sungguhpun keputusan mahkamah telah jelas, mereka tidak pernah putus asa untuk menyusun perancangan demi perancangan sehinggalah agenda mereka untuk menembus ke dalam sistem mahkamah syariah untuk beraksi sebagai peguam kini seakan berjaya!

Namun, sebagai seorang Islam, kita amat yakin, Allah akan terus membela dan melindungi agamaNya daripada dipersendakan kaum kafir. Saya percaya, hal ini berlaku dengan kehendak Allah dan izinNya. Dia mahu melihat ghirah kita, izzah kita, sensitiviti kita dalam mengangkat agamaNya apabila ada musuh yang mahu menjatuhkannya. Inilah ujian yang dirancang oleh Allah untuk menyaring kita sebagai pejuang agamaNya. Siapa dahulu yang akan bertindak? Siapa dahulu yang akan merancang? Dan siapa dahulu yang mahu berkorban untukNya?

Announcement to Students Volunteers

7th ASLI Conference 2010


Dated: 03-04-2010


Assalamualaikum.

Dear Students Volunteers.


1. Selection of Students Volunteers: The Organizing Committee has selected Students Volunteers for 7th ASLI Conference 2010 (See Annex I). We indeed appreciate strong support shown by our students. We nevertheless deeply regret for those who are involved in LAP Programme because we cannot accept them for administrative reasons. Moreover, we would also like to request those students, who are selected but not for the Committee they opted for, to bear with us because we need to make some changes to get the required number of students for each and every committee.


2. Confirmation of Commitment: Students Volunteers are required to come to the ASLI Conference Secretariat Office (AIKOL Level 2, near the main staircase) and confirm their commitment ASAP by signing up in the given form. Br. Rezal (PA of the ASLI Secretariat) will assist you (Secretariat Office Tel. No. 6196 4000 ext 3215; Br. Rezal’s HP: 012-2569855). He is available every week day from 10.am to 5 pm. Those who need accommodation during 18 May to 26 May have also to fill a form for stay at Mahallah. The deadline for confirmation is 9th April 2010 and those who fail to confirm will be replaced by students from the reserved list.


3. Training Workshop: The training workshop, which is compulsory for all students Volunteers, will be on 19 May (See Annex II for the tentative programmed). Students Volunteers have to be in IIUM at least from 18 May to 26 May. Those who go back home have to come back on 18 May at the latest.
